01 Who may apply #
You must be 18 years of age or older. We do not accept applications from minors and do not photograph minors in these installments.
You must submit truthful information. Applications containing false statements about identity, age or professional background may be rejected or withdrawn at any stage, including after payment.
02 An application is not a booking #
Submitting an application, or registering interest in a future installment, does not create a booking, reserve a place, or obligate us to select you.
We build each roster by hand, weighing craft, discipline, story and the balance of the collection. We are not obligated to explain a decision, though we usually try.
Any dates, prices, package contents and deliverable counts shown before you are selected are tentative and may change. Nothing is confirmed until we confirm it in writing and you accept.
03 Fees and refunds #
Package prices are stated on the application form for each installment.
- Payment is due by the deadline stated for your installment. Missing it may release your place to the waiting list.
- Fees are non-refundable once paid. Production capacity, studio time, crew and materials are committed against your place, and they cannot be recovered if you withdraw.
- If we cancel an installment outright and do not offer you a place on a rescheduled date, we refund your fee in full.
- If we reschedule and you cannot make the new date, we will offer you a place in the next installment for which you are eligible or, at our discretion, a refund.
- We do not charge for applying or for registering interest.
04 Dates change, and how you will hear about it #
Production dates, meeting dates and call times are tentative until confirmed, and may change afterward. Weather, venue availability, crew availability and the realities of an independent production all move dates.
You will receive written notice of every change. Notice goes by email in every case. If you have opted in to text messages, you will also receive a text. If a calendar invitation was issued, it will be updated.
Email is the notice of record. Text is a convenience, and it is not guaranteed to be delivered — carriers filter messages and phones go out of service. Do not rely on text messages alone. If a date matters to you, confirm it against the email or the site.
05 Being photographed #
If you are selected:
- A model release must be signed before you can be photographed. No release, no session — there is no exception to this.
- Arrive camera-ready. Hair and makeup are completed before call time unless your package states otherwise.
- Wardrobe follows the stated parameters for your installment. Your first look follows the installment theme. Additional looks are your choice within the stated limits — no swimwear, no club attire.
- Behind-the-scenes footage is captured by the production team. Participants do not film their own behind-the-scenes content on set.
- Guests remain outside the production space. You may bring someone; they will not be on set.
- Conduct. We may end a session and remove anyone whose conduct is unsafe, harassing, or disruptive to other participants or crew. No refund is owed in that case.
06 Photographs, copyright, and what you may do with them #
Read this section carefully — it is the one people most often assume they know.
Copyright in every photograph and video produced in an installment is owned by Reminiscent Road Media LLC, the production company that shoots and edits the work. It is not owned by you and it is not transferred by paying for a package.
What you receive is the retouched deliverable set stated in your package, together with a perpetual, worldwide, royalty-free license to use those delivered images to promote yourself and your own work — your portfolio, your reel, your social media, your press materials, your agent’s submissions. You do not owe us a fee for that use and you do not need to ask.
What that license does not include: you may not resell the images, license them to a third party, use them in paid advertising for a product or brand other than your own professional services, or alter them in a way that changes the work (filters, crops, recolors, AI edits). Credit “Framing the Moment” where the platform allows it.
What we retain. Framing The Moment Holdings LLC and Reminiscent Road Media LLC retain the right to use, edit, publish, exhibit and promote the images and footage as part of the installment and the collection, including on the site, in press, in exhibitions, and in promotion of future installments. Creative control of the collection stays with the production.
Release dates. Editing and release are staggered. We do not promise a public release date and none is implied by your payment.
Additional frames and prints. If you want images beyond your package, or physical prints, you buy them directly from Reminiscent Road Media LLC through its client portal, under its terms — not from Framing the Moment. We do not sell photographs and we do not take money for them.
07 Your content #
When you submit a headshot, portfolio links, a description of your body of work, or social handles, you confirm you have the right to give them to us, and you grant us permission to use them to evaluate your application and plan the production. If you are selected, you also grant permission to use your name, credited name, role and a short professional biography in connection with the installment and its promotion.
You keep ownership of everything you submit. Tell us to stop using any of it and we will, subject to work already published.
07A Framing Index #
Framing Index is a consent-based directory of deliberately published creator profiles and moderated production credits. Search, profile claims, corrections, disputes, withdrawal, and opt-out are free at launch. We do not charge retroactively for an action you completed while it was free.
An application is not Index consent. Neither is selection, a release, a booking, participation, photography, an Origins Map choice, or a prior relationship with us. A profile can appear only after you are confirmed as an official participant, separately choose profile publication, and pass human moderation. Media, professional links, general availability, and Index-related marketing each require their own choice.
“FTM verified” means Framing the Moment reviewed evidence for the labeled identity or production credit. It is not a rating, endorsement, professional license, background check, promise of availability, or guarantee that another person will hire or contact anyone. User-supplied details are labeled separately. Disputed credits may be withheld while reviewed.
Creators may claim, correct, dispute, withdraw, delete, or opt out of a profile through a verified, moderated request. A request never edits public fields automatically. Opting out of Index does not cancel a separate application, booking, release, or Origins Map choice.
Do not use Index to harass, stalk, discriminate against, impersonate, or misrepresent another person; harvest contact details; create a competing bulk database; or make automated requests that degrade the service. Public professional links remain subject to the destination site’s terms.
08 Communications #
By applying, you agree that we may contact you by email about your application and any installment you have applied to or registered interest in. This is how we deliver notice under §4 and you cannot opt out of it while an application is active — but you may withdraw the application at any time.
Text messages are separate and optional. They require the specific consent described in Privacy Policy §5, they are never a condition of applying or of buying a package, and you can stop them at any time by replying STOP or by telling us in any other way.
09 Using this site #
Do not attempt to access accounts or data that are not yours, probe or interfere with the site’s security, scrape it at a rate that degrades it for others, submit automated or fraudulent applications, or upload anything unlawful or infringing.
We may suspend access for any of the above.
10 Disclaimers and limitation of liability #
The site and our services are provided “as is.” We do not warrant that the site will be uninterrupted or error-free, that any message will be delivered, or that participation will produce any professional, commercial or promotional outcome.
Framing the Moment does not promise you work, representation, exposure, followers, or income. We produce photographs and operate a moderated directory.
Index search results, availability labels, professional links, and user-supplied details may change. Verify information directly before making a hiring, contracting, safety, or financial decision. Framing Index is not a substitute for references, identity checks, licenses, insurance, contracts, or a background check.
To the fullest extent permitted by Texas law, our total liability to you arising out of these terms, your application, or your participation is limited to the amount you actually paid us for the installment in question, and we are not liable for indirect, incidental, consequential, special or punitive damages, or for lost profits or lost opportunity — even if we were told they were possible.
Nothing here limits liability that cannot be limited by law, including liability for gross negligence, willful misconduct, or personal injury caused by our negligence.
11 Indemnity #
You will indemnify Framing The Moment Holdings LLC, its members, and Reminiscent Road Media LLC against claims arising from your breach of these terms, your infringement of someone else’s rights in material you submitted, or your conduct on a production.
12 Termination #
You may withdraw an application at any time by emailing us; §3 governs whether a fee is refundable.
We may reject or withdraw an application, or remove a participant, for a breach of these terms, false information, or conduct under §5.
13 Governing law and venue #
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Subject to §14, the exclusive venue for any dispute is the state and federal courts located in Harris County, Texas, and you consent to jurisdiction there.
We name Harris County rather than Travis County, where our registered agent’s office sits, because Harris County is where this company’s decision-makers conduct its daily affairs and where the productions, meetings and payments these terms concern actually happen — under Texas venue law the presence of a registered agent alone does not make a county a company’s principal office, so naming Travis County would name a courthouse neither of us has a real connection to.
14 Dispute resolution — arbitration and class-action waiver #
Read this section It affects how any dispute between us is decided, and it limits your ability to bring or join a class action. You may opt out of it within 30 days at no cost and with no effect on your application — see Opt out, below.
Talk to us first. Before starting any formal proceeding, email info@framingthemoment.net describing the dispute and what you want. We will try in good faith to resolve it within 30 days. Most things end here.
Arbitration. If we cannot resolve it, any dispute arising out of these terms, your application, your participation, or any communication we send you — including any claim under the Telephone Consumer Protection Act — will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Harris County, Texas, rather than in court. The Federal Arbitration Act governs this section.
Class-action waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. An arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to all other claims.
Small claims. Either of us may bring an individual claim in small claims court instead.
Opt out. You may opt out of this arbitration section by emailing info@framingthemoment.net with the subject line “Arbitration Opt-Out” within 30 days of first accepting these terms. Opting out costs you nothing and affects nothing else — your application and your place are unaffected.
15 General #
These terms and the Privacy Policy are the entire agreement between us regarding the site and your application, and they supersede prior discussions. A signed model release, a signed participation agreement, or a written confirmation of your booking controls over these terms where they conflict.
We may update these terms; the effective date at the top will change and material changes will be emailed to anyone with an active application at least 14 days in advance. Continuing to use the site or proceeding with an application after that date means you accept the update.
If any provision is unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor to the business.
